Carole Pateman The Contract and Domination

Contract and Domination offers a bold challenge to contemporary contract theory, arguing that it should either be fundamentally rethought or abandoned altogether. Since the publication of John Rawls's A Theory of Justice, contract theory has once again become central to the Western political tradition. But gender justice is neglected and racial justice almost completely ignored. Carole Pateman and Charles Mills's earlier books, The Sexual Contract (1988) and The Racial Contract (1997), offered devastating critiques of gender and racial domination and the contemporary contract tradition's silence on them. Both books have become classics of revisionist radical democratic political theory. Now Pateman and Mills are collaborating for the first time in an interdisciplinary volume, drawing on their insights from political science and philosophy. They are building on but going beyond their earlier work to bring the sexual and racial contracts together. In Contract and Domination, Pateman and Mills discuss their differences about contract theory and whether it has a useful future, excavate the (white) settler contract that created new civil societies in North America and Australia, argue via a non-ideal contract for reparations to black Americans, confront the evasions of contemporary contract theorists, explore the intersections of gender and race and the global sexual-racial contract, and reply to their critics. This iconoclastic book throws the gauntlet down to mainstream white male contract theory. It is vital reading for anyone with an interest in political theory and political philosophy, and the systems of male and racial domination.

Carole Pateman The Sexual Contract

Carole Pateman is one of the foremost political theorists writing in English today. In this outstanding new work, she presents a major reinterpretation of modern political theory. She shows how standard discussions of social contract theory tell only half the story. The sexual contract which establishes modern patriarchy and the political right of men over women is never mentioned. In a wide-ranging and scholarly discussion, Pateman examines the significance of the political fictions of the original contract and the slave contract. She also offers a sweeping challenge to conventional understandings – of both left and right – of actual contracts in everyday life: the marriage contract, the employment contract, the prostitution contract and the new surrogacy contract. By bringing a feminist perspective to bear on the contradictions and paradoxes surrounding women and contract and the relation between the sexes, she is able to shed new light on the fundamental problems of freedom and subordination. The Sexual Contract will become a classic text in the politics of gender and will be of major interest to students of social and political theory and philosophy, women's studies, sociology and jurisprudence.

Christine Keating Decolonizing Democracy

Most democratic theorists have taken Western political traditions as their primary point of reference, although the growing field of comparative political theory has shifted this focus. In Decolonizing Democracy , comparative theorist Christine Keating interprets the formation of Indian democracy as a progressive example of a “postcolonial social contract.” In doing so, she highlights the significance of reconfigurations of democracy in postcolonial polities like India and sheds new light on the social contract, a central concept within democratic theory from Locke to Rawls and beyond. Keating’s analysis builds on the literature developed by feminists like Carole Pateman and critical race theorists like Charles Mills that examines the social contract’s egalitarian potential. By analyzing the ways in which the framers of the Indian constitution sought to address injustices of gender, race, religion, and caste, as well as present-day struggles over women’s legal and political status, Keating demonstrates that democracy’s social contract continues to be challenged and reworked in innovative and potentially more just ways.

Michael Rowlinson Practical Guide to the NEC3 Engineering and Construction Contract

Launched in 1993, the NEC Engineering and Construction Contract has become one of the UK's leading standard forms of contract for major construction and civil engineering projects. The third edition, popularly known as NEC3, is a process based contract embodying project and commercial management best practice, so its basic philosophy differs from the more adversarial approach of other standard construction contracts. Since the first edition of this book, the third edition of the contract has seen the introduction of a new secondary option for use in the UK and amendments to a number of clauses. In addition, in September 2011, changes were introduced to cater for the amendments to the Housing Grants, Construction and Regeneration Act 1996 contained in the Local Democracy, Economic Development and Construction Act 2009, which became effective for all new contracts entered into from 1 October 2011. These amendments have been incorporated into the text. A Practical Guide to the NEC3 Engineering and Construction Contract will be useful to everyone in the construction industry working on a project under this contract. It will be of interest to the complete construction supply chain, including employers, construction professions, contractors and sub-contractors, as well as consultants and lawyers advising any of these parties, either in the preparation of contract documentation or the day to day management or the resolution of problem situations which may arise.

Vincent Powell-Smith Contract Documentation for Contractors

The JCT standard forms of building contract require a thorough understanding of their procedural requirements, as well as their legal implications. They require both the contractor and the architect, on behalf of the employer, to send a wide range of notices and letters if each party is to protect its legitimate interests. The main contract forms are also supported by complex sub-contract documentation. Therefore, it is not surprising that when this book of specimen letters, notices and forms was first published, it was widely welcomed by the construction industry. The book provides examples of documentation likely to be required for a contract under the following JCT forms: ? the Standard Form of Building Contract ? the Intermediate Form of Building Contract ? the Agreement for Minor Building Works ? the Standard Form of Building Contract With Contractor's Design It includes a commentary on the practical implications of the various documents and highlights the points to be watched. The new edition takes into account the wide range of amendments to the latest editions of the standard forms following the Housing Grants, Construction and Regeneration Act 1996, and in particular, the new payment and adjudication provisions. For the first time it features documentation for use with the JCT design and build form.

David Chappell Building Contract Claims

Many building projects are the subject of claims – the assertion of a right, usually by the contractor, to an extension of the contract period or an additional payment under the terms of the building contract. Many of these claims are unsound or ill-founded, often because the basic principles are misunderstood. This highly regarded book examines the legal basis of claims for extensions of time and additional payment, and what can and cannot be claimed under the main forms of contract. It includes chapters dealing with direct loss and expense, liquidated damages, extension of time, concurrency problems, acceleration, time at large, common law and contractual claims, global claims, and heads of claim and their substantiation. With the publication of the fifth edition, Building Contract Claims has been thoroughly revised to ensure it is fully up to date with the latest contracts, court judgments and building practice. Changes include: Coverage of over 60 additional relevant court cases Coverage of the 2005 JCT contracts suite Coverage of changes to the NEC contract Coverage of additional contracts such as Constructing Excellence; Measured Term Contract and the ACA PPC2000 contract together with the 2005 relevant JCT sub-contracts Important changes to liquidated damages and to extensions of time, and the giving of notices Appendix 1 has been substantially revised Like its predecessors, the fifth edition of Building Contract Claims will be essential reading for architects, contract administrators, project managers and quantity surveyors, as well as contractors, contracts consultants and construction lawyers.
